Acceptance of these Terms

Unity Capital Partners AG and its subsidiaries, their directors, officers and agents (together “Unity”) shall communicate with you via email subject to your agreement to accept and comply with the following terms of use (“Email Terms of Use”).

Your receipt of any email from Unity and/or your continued use of email with us, constitutes your acceptance of these Email Terms of Use and if you are not willing to be bound by them, you should discontinue your use of email to us forthwith.

Limitation of Liability

Except as required otherwise by applicable law, Unity does not accept any responsibility and shall not be liable for any loss or damage whatsoever, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with:

• use of or reliance on any information, opinions, content and/or material contained in an email message including its attachments;
• interruption or delay in access, use of, or inability to use or access of such emails;
• improper, incomplete or delayed transmission of the information contained in any email message;

Where a claim is brought against any member of Unity’s corporate group by a third party in relation to your use of email, you hereby agree to fully reimburse the respective entity for all losses, costs, actions, proceedings, claims, damages, expenses (including reasonable legal costs and expenses), or liabilities, whatsoever suffered or incurred directly by such entity as a consequence of improper use of this Website. 

Neither party should be liable to the other for any loss or damage which may be suffered by the other party due to any cause beyond the first party's reasonable control including without limitation any power failure.

General

Any email messages sent from a Unity address (including their content and any attachments thereto) are intended for the named recipient(s) only and may be privileged and confidential. If you have received an email message from Unity by mistake, please notify the sender by return e-mail and delete the message from your system.

Any unauthorized use or dissemination of such emails in whole or in part is strictly prohibited.

The information included within each email and its attachments (if any) are for informational purposes only. To the fullest extent permitted by applicable law, we exclude all conditions, warranties and representations in relation to all email messages, whether expressed or implied.

Except as required otherwise by applicable law, we will not be liable for any loss or damage caused to your information technology, computer programs, platform, data or other proprietary material arising in connection with receipt of any email from Unity.

No Contract

Unity does not enter into or accept any form of contract by email unless expressly agreed and acknowledged by Unity. Any views or opinions presented are solely those of the author and do not necessarily represent those of Unity.

Viruses and Compatibility

Whilst Unity believes that all emails (including any attachments) which are sent from our systems are free from viruses, we cannot guarantee that our email messages are free from malfunctions, defects, malware, bugs and viruses.

Accordingly, we accept no responsibility for any loss or damage caused by an email which occurs as a result of any virus, including without limitation any distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other materials.

You are responsible for configuring your information technology, computer programs and platform in order to receive and read our email messages and for protecting yourself with your own anti-virus software, firewalls and any other related technical measures. We give no warranties as to the compatibility of our email message format with your information technology, computer programs and or IT platform.

You must not misuse our email system by knowingly introducing viruses, trojans, worms, logic bombs, keystroke loggers, spyware, adware, and/or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware, or which is otherwise malicious or technologically harmful. You must also not attack our email servers via a denial-of-service attack or a distributed denial-of service attack, or in any other way. 

Any attempt to violate the security of our email system is strictly prohibited and may result in criminal and civil liabilities to you. Any and all alleged violations will be investigated, and, if a criminal violation is suspected, we will fully cooperate with the relevant law enforcement agencies and assist them in their investigations.

Intellectual Property Rights

The Unity name, logo and slogan ‘Investing. Together' contained in our email messages are trademarked and are used by Unity under license agreement. The trademark holder is not affiliated with, nor does it endorse Unity's products or services. Use of such registered name and or trademarks does not imply any affiliation with or endorsement by such party. No email may be copied, reproduced, modified, publicly displayed, republished, distributed, extracted or reused in any form, without the prior written permission of Unity.

Severance 

Should one or more provisions of these Email Terms of Use be or become invalid or unenforceable in whole or in part, this shall not affect the validity and enforceability of the remaining provisions. In place of any provisions which are invalid or not incorporated in these Email Terms of Use, the relevant statutory provisions shall apply. In all other cases, the parties shall agree a valid provision to replace the invalid or unenforceable provision which reflects as closely as possible the original economic purpose, provided a supplementary interpretation of these Email Terms of Use does not have precedence or is not possible.

Waiver

The rights of Unity under these Email Terms of Use may only be waived in writing.

Governing Law

The terms and conditions of this legal notice shall be governed by and construed in accordance with the laws of Switzerland. You agree that any dispute or action at law or in equity arising out of or relating to these terms or any visitor’s use of this Website shall be commenced only in the courts of Zurich and hereby consent and submit to the jurisdiction of such courts for the purposes of any such dispute or action.

Variations

We may update or change these Email Terms of Use from time to time, and may accordingly suspend, withdraw, discontinue or change all or any part of this legal disclaimer without notice. When we change our Email Terms of Use, we will publish the updated terms on our Website at: www.unity.capital/email-terms-of-use which subject to applicable law, all changes will take effect as soon as such changes are published.
